Terms of Purchase

1. Introduction These purchase terms and conditions (“Terms”) govern the sale of products and services through the website miriell.com (“Website”) to customers within the European Union. By making a purchase through the Website, you fully accept these Terms. The Terms comply with consumer protection legislation in accordance with the EU Distance Selling Directive, Consumer Sales Directive, and other applicable mandatory laws, and constitute a legally binding agreement between the buyer (“you”) and the operator of the Website (“we”).

 

2. Orders and Confirmation Purchases are made through the order form on the Website. An order becomes binding only once full payment has been received by us. The email confirmation is merely a technical receipt and does not constitute a legally binding agreement. We reserve the right to reject an order without providing a reason, for example in cases of suspected abuse, incorrect information, or technical errors.

 

3. Prices and Payment All prices are stated in euros (EUR) and include VAT unless otherwise specified. Payment is made via the options listed on the Website. We reserve the right to change prices before a purchase is completed. The applicable price is the one shown at checkout at the time of payment. Payment must be completed in full before delivery is made. If payment is not received, no delivery or purchase agreement will occur.

 

4. Delivery Delivery is made using the methods offered on the Website. Stated delivery times are estimates, and we are not liable for delays caused by third parties or circumstances beyond our control. The risk for the item passes to you once it has been handed over to the carrier. It is your responsibility to ensure that the address and contact information provided are correct. If incorrect delivery information results in non-delivery, you are fully responsible for any additional costs or missed delivery.

 

5. Right of Withdrawal As a consumer within the EU, you have a legal right to withdraw from a purchase within 14 days from the date you received the item. To withdraw from a purchase, you must contact us by email within the stated period. The product must be returned in substantially unchanged condition and at your own expense. The item must not have been used, damaged, or lack its original packaging. Refunds will be issued within 14 days after we have received and approved the return.

 

6. Exceptions to the Right of Withdrawal The right of withdrawal does not apply to digital content delivered electronically where you have explicitly consented to the commencement of delivery. Nor does it apply to products that are custom-made according to your instructions or clearly personalized.

 

7. Complaints If a product is defective under applicable EU consumer legislation, you have the right to make a complaint within two years from the purchase date. Defects must be reported to us within a reasonable time after you discover the issue. We recommend that you inspect the delivery immediately upon receipt and contact us within 48 hours in case of visible transport damage. Upon an approved complaint, we will remedy the issue through repair, replacement, or refund. We are not liable for damage caused by misuse, careless handling, normal wear and tear, or resale to third parties.

 

8. Force Majeure We are not liable for delays or damages caused by events beyond our control, such as natural disasters, war, terrorism, pandemics, government actions, strikes, disruptions among suppliers or carriers, or other unforeseen events that significantly hinder our ability to fulfill our obligations. In the event of force majeure, our delivery times or other obligations will be extended without liability for damages or penalties.

 

9. Limitation of Liability We disclaim all liability for indirect damages, loss of profit, data loss, or other consequential damages. Our liability is in any case limited to the amount you paid for the product or service. We do not guarantee that the products are suitable for a specific purpose, and use is at your own risk. We reserve the right for any technical errors, typographical mistakes, pricing errors, stock discrepancies, or incorrect product descriptions on the Website. In such cases, we reserve the right to correct the error and cancel or adjust your order as necessary.

 

10. Personal Data The processing of personal data in connection with purchases is governed by our Privacy Policy. By completing a purchase, you consent to our processing of your data in order to fulfill the agreement, including order handling, communication, and potential returns.

 

11. Disputes In the event of a dispute, we follow the decisions of relevant European dispute resolution bodies or Swedish courts. Disputes are governed by Swedish law, with the Stockholm District Court as the first instance, unless otherwise required by mandatory consumer protection legislation.

 

12. Changes to the Terms We reserve the right to change these Terms at any time. The version in effect is the one published on the Website at the time of your order. We recommend that you always read the Terms before making a purchase.
